Acceptance

By purchasing products and/or services from the Five Star Music Site, you agree to be bound by and accept this Agreement. Orders are not binding upon Five Star Music until accepted by Five Star Music. We reserve the right to refuse service to anyone. Five Star Music will indicate its acceptance of an order by acknowledging your order by reply email or by shipping the ordered items to you.

Prices and Payment

All prices are in $ Australian and include 10% GST. Because prices, product descriptions, and availability can change quickly, Five Star Music does not warrant the accuracy or completeness of the information provided on the Site. Payment is available with Visa & Mastercard through the paypal gateway on our site. (Paypal account not required) Bank Deposit is also available. Delivery

We only deliver to Australia & New Zealand unless otherwise stated. We cannot guarantee delivery times but we aim to ship within 3 working days. Larger items are delivered via courier and cannot be left until someone signs for the parcel. Couriers cannot deliver to P.O.Box addresses.

Delivery Costs

The delivery costs for Australia are as follows: $10 for orders up to the value of $99, Free Delivery for orders over $99

Purchasing

All items offered on our website are subject to availability. All items listed are believed to be in stock. Occasionally an error may occur, or multiple transactions occurring simultaneously may mean stock levels are momentarily inaccurate. Should an item be out of stock, we will advise you via email and offer you either
a) the timeframe until your item is back in stock
b) an alternative item
c) a refund on your purchase
Items in your shopping cart will reflect the most recent price displayed on the item's product detail page. Prices are frequently updated to adjust for different sales, limited pricing, and other discounting. Therefore, prices on the product detail page and in your cart may change after such updates to reflect the current prices. Placing items in your cart does not reserve the current prices shown at that time, and prices are reserved only by placing an order. From time to time, despite our efforts, a small number of the items may be mispriced. Please note that such errors or inaccuracies may be related to product descriptions, pricing and availability. In the event of a pricing error, Five Star Music will take one of the following options: (1) If an item's correct price is lower than our stated price, we will charge the lower amount and ship you the item; or (2) if an item's correct price is higher than our stated price, we will, at our discretion, either contact you for instructions before shipping or cancel your order and notify you of such cancellation. We apologise for any inconvenience

Returns

We do not refund for "change of mind." We will credit your purchase amount which you may use to purchase any other products on the site. The goods must be returned in new condition and with all packaging within 14 days and we would recommend for your own protection that you use a recorded delivery service.

Warranties

All new products are sold with the manufacturer's limited warranty. The warranty period and service varies by manufacturer and product. All warranty items must be returned to us at the buyers expense for warranty work. All items purchased from Five Star Music are made pursuant to a shipment contract. This means that the risk of loss and title for such items passes to you upon our delivery to the carrier. FIVE STAR MUSIC WILL NOT BE HELD LIABLE FOR ANY DAMAGE INCURRED DURING SHIPPING

By submitting your name, e-mail address, and any other personal information to Five Star Music, you hereby grant Five Star Music, a license to use and disclose this information in connection with periodic mailings to you about Five Star Music products, services, and news.

Limitation of Liability

IN NO EVENT SHALL FIVE STAR MUSIC BE LIABLE FOR ANY INDIRECT, INCIDENTAL OR CONSEQUENTIAL DAMAGES OF ANY KIND, INCLUDING, WITHOUT LIMITATION, THOSE RESULTING FROM LOSS OF USE, DATA, OR PROFITS, WHETHER OR NOT FIVE STAR MUSIC HAS BEEN ADVISED OF THE POSSIBILITY OF DAMAGES, ON ANY THEORY OF LIABILITY, ARISING OUT OF OR IN CONNECTION WITH THE USE OF THE INFORMATION ON OUR SITE.
